Boards and Commissions – Eligibility

Charter Amendment

 

The Question:

Should the Santa Monica City Charter be amended to change the eligibility requirement for the Library Board, Personnel Board, and the Airport Commission from “qualified elector” to “resident” of the City of Santa Monica to ensure compliance with compensation and reimbursement laws?

 

Background:

Unlike other City boards and commissions, the Library Board, the Personnel Board and the Airport Commission eligibility requirements in the City Charter includes outdated language that says members must be “electors” in the City in order to serve, and this has been interpreted to limit service to US citizens.

 

Section 1005 of the City Charter provides that the City reimburse members of boards and commissions for certain travel expenses.

 

The Proposal:

  • Amends the City Charter to change the phase “qualified electors” to “residents”, making the eligibility requirement for appointment to the Library Board, the Personnel Board and the Airport Commission consistent with other City boards and Commissions.

  • Amends Section 1005 of the City Charter to clarify that the City will provide reimbursement to board and commission members only when doing so is consistent with applicable federal, state and local laws.

 

Fiscal Effect: none

 

Supporters Say:

  • This measure is a straightforward, simple clean-up of dated language to create consistency in the eligibility requirement for all City boards and commissions.

  • Expands opportunities for civic participation to all our residents, not just to U.S. citizens.

 

Opponents Say: No argument against the measure was submitted.
